    From a strictly legal point of view UN member states actually have given up their right to wage war, since they are bound by Article 2.4 of the Charter which says that "all members shall refrain in their international relations from the threat or use of force".

    I still can't find any official government documentation that records declaration of war on Iraq. Even on google.

    There is no war in Iraq. I don't see any reports of anyone officially declaring war on Iraq.

    Scroll down to Page 3 paragraph 1. UN recognition of material breach of the 1991 ceasefire agreement. The whole argument was not about declaration of war, we'd already done that, but if we should pass another UN resolution or act upon the breach of 1441. The coalition force decided to act. It did not legally require further acts to do so, but in my opinion was wrong to invade at that time. As you can see from paragraph 2, the UNSC voted for more time. It's a legal minefield.
